A seller Selling unbraded product on my Brand Name by FBM

Hello Dear Brand owner Sellers,

I wonder if you can help me. I am a small brand owner and I sell my own products mainly on amazon. However I have noticed that another seller has appeared on my listing pretending to be selling my branded product by fbm. I now that product cannot be genuine as I do not have distribution agreements with anyone and I don't sell to other sellers on wholesale.

I reported this issue to amazon brand registry for infringement Under case ID 11073202492. But I was disappointed to receive below reply.

"Thank you for contacting Brand Registry Support. We reviewed your submission and are unable to take the action you requested.

If you have additional notices that you wish to submit, our team only investigates one type of infringement per submission and no more than 50 ASINs per submission. If you have more than one type of infringement, we require that separate submissions be made for each infringement type.

For example:

If you would like to submit three ASINs for two different infringement types, you would submit one notice for each infringement type. This would be a total of two notices. If you have more than 50 ASINs that you would like us investigate, you will need to submit multiple notices with no more than 50 ASINs per submission.

If you believe this decision was made in error, please tell us why by submitting a new complaint through Brand Registry. We are unable to take further action on the complaint you previously submitted."

Now How do I deal with this issue?

I feel that all my hard work to establish my brand could be wasted if random seller just start selling unbranded products on brand name through fbm .

There are a few possible sellers with a similar brand name so this could be wrong but is this in relation to ASIN B0CGPYNZQT?

If so that is a widely available product made by the multinational brand Virbac that has been misbranded as AS TRADERS.

this happened to me - took me for ever to get them off it.

First do a test buy so you have evidence that it is not

This is what they said:

Going forward, if the product delivered in your test-buy does not bear your trademark on the product or its packaging, but is not your own product, this should be reported as “Product not as described” using your Brand Registry account:

Click on “Support – Contact Brand Support”:

Click on “Report a marketplace policy violation” and then “Product not as described”:

Points to note:

Amazon respects a brand owner’s right to enter into distribution agreements for its products; however, violations of such agreements do not constitute intellectual property rights infringement, so cannot be reported through Brand Registry. Please therefore ensure that the phrasing of your future reports do not make reference to “unauthorized Sellers” or “This is my ASIN and I am the only owner”, and instead focus on the violations that took place.

Amazon is an open marketplace, we welcome the opportunity from all sellers to offer products from brands, whether directly or indirectly sourced, as long as the products sold are authenticA test buy is mandatory for each “Product not as described” report. Please note that a test buy needs to include all the following criteria for it to be valid:

Seller and ASIN on the order must match with the Seller and ASIN being reported.

The order has to be delivered by the time of the report.

Normally Amazon should remove the seller from your listing. If it is your branded product. However, If you just create your own listing with another branded product. They might not take action. Such as 12xset Coca-Cola cans under your brand.

post.i think the problem here is so many products are available to buy and then people are putting their own brand on them but if somebody else has bought the product from where you got it as well why shouldn't they sell it. The only own branded product I would sell are ones you have designed and made yourself personally not purchased through a third party. If this is not th3 case then they are in the wrong.
